Section 01
Services Covered
These Terms & Conditions govern all bookings made with A.L.O.N.E. Studio, the creative division of A Life Of New Experiences, headquartered in Jamaica. They apply to the following service types:
- Photography (portrait, editorial, event, commercial)
- Videography (event coverage, brand films, music videos)
- Hybrid Coverage (combined photo and video)
- All associated add-on services listed under Section 4
These terms come into effect upon the Client's submission of a booking form and are formalised upon receipt of the non-refundable Retainer payment.
Section 02
Fees & Payment
All fees are quoted and payable in Jamaican Dollars (JMD) unless otherwise agreed in writing.

Late Payment: Outstanding balances not paid by the agreed due date will accrue compound interest at 1.5% per month (18% per annum), or the maximum rate permitted under Jamaican law, whichever is lower. The Client shall also be liable for all reasonable legal and debt collection costs.
Accepted payment methods include Electronic Funds Transfer (EFT), Credit/Debit Card via secure portal, and Cash.
Section 03
Retainer Policy
To officially secure your chosen date, time, and resources, a non-refundable retainer of 50% of the Total Service Fee is required.
Why is the retainer non-refundable? The Parties expressly agree that this retainer constitutes liquidated damages, a genuine pre-estimate of the Studio's anticipated loss upon cancellation. It compensates the Studio for reserving the date, declining other commercial commissions, and undertaking preparatory work on your behalf.
The retainer will only be returned in the event of a direct breach of contract by the Studio, or in qualifying Force Majeure circumstances as defined in Section 13.
If the full balance is not received within 14 calendar days of the scheduled service date, the Studio reserves the right to immediately suspend services and the retainer will be forfeited.
Section 04
Add-Ons & Additional Services
The following supplementary services are available and must be confirmed and agreed upon in writing prior to the service date:
- Additional Hours: Billed at the agreed hourly overtime rate. Overtime is subject to the Studio's physical availability on the day and is not guaranteed.
- Second Shooter / Assistant: Available at an additional fee to be quoted.
- Behind The Scenes (BTS) Content: Social media-ready behind-the-scenes footage, quoted separately.
- Drone (UAS) Coverage: Subject to the Aviation Compliance terms below.
Drone / Aviation Compliance: All drone operations are governed by the Jamaica Civil Aviation Authority (JCAA). Drone coverage is strictly contingent upon favourable weather conditions, a valid Special Aerial Work Permit, and the pilot's real-time safety assessment. The Studio is legally prohibited from flying over heavy crowds, above 400 feet, or beyond visual line of sight. If drone operations must be grounded due to safety or regulatory restrictions, a pro-rated refund solely for the drone add-on value will be issued.
Section 05
Delivery & Archiving
Final digital deliverables will be delivered via a secure private gallery link sent to the Client's registered email address.
- Standard Delivery: Turnaround time will be specified at the time of booking confirmation.
- Rush Delivery (48–72 hours): Available subject to Studio availability, at a surcharge of 20% of the Total Fee.
- Priority Rush (24–48 hours): Available subject to Studio availability, at a surcharge of 30% of the Total Fee.
Archiving Limitation: The Studio will maintain your active digital gallery for 60 days following the initial delivery date. After this period, the Studio holds no legal obligation to store, archive, or retrieve your files. You are solely responsible for downloading and backing up all files upon receipt.
Section 06
Creative Control & Artistic Fulfillment
By booking A.L.O.N.E. Studio, the Client acknowledges they are engaging the Studio based on its established public portfolio and unique artistic vision.
The Studio retains full creative control over all aspects of production and post-production, including lighting, composition, stylistic execution, colour grading, and editing choices.
RAW Files: The Studio does not provide unedited RAW files or outtakes as standard practice, as these do not represent the Studio's finished professional standard. RAW file delivery may be arranged if explicitly requested and agreed upon in writing before the service date.
The Client may not reject final deliverables or demand refunds based on subjective stylistic preferences, aesthetic taste, or compositional choices that fall within the Studio's established style.
Section 07
Intellectual Property & Licensing
In accordance with the Jamaica Copyright Act 1993 (and subsequent amendments), A.L.O.N.E. Studio is the legal author and exclusive first owner of the copyright in all photographs and video footage created under this agreement. No transfer of copyright is implied by the execution of a booking.
Upon full and final payment of the Total Fee, the Client is granted a licence as follows:
- Personal Use Licence (Standard): A non-exclusive, non-transferable, perpetual licence to use, print, and reproduce images for personal, domestic, and non-commercial purposes. The Client may not sell the images, use them for commercial advertising, or submit them to publications without prior written consent.
- Commercial Use Licence (Additional Fee): A non-exclusive licence covering commercial promotion, corporate branding, and marketing, subject to specific geographic, temporal, and platform limitations detailed in a separate Commercial Addendum.
Attribution: For all public digital deployments (Instagram, TikTok, Facebook, etc.), particularly by content creators, influencers, or commercial brands, clear and legible credit to "A.L.O.N.E. Studio" must be provided in the caption. The Client may only tag the Studio's accounts on content that has been explicitly approved by the Studio.
Section 08
Data Protection & Privacy
The creation, delivery, and storage of photographic and videographic media inherently involves the collection and processing of personal and biometric data. By confirming a booking, the Client provides informed, explicit consent for the Studio to process this data in compliance with the Jamaica Data Protection Act (2020), solely for the fulfillment of the agreed services.
To facilitate efficient delivery of high-resolution files, the Client consents to the Studio utilising third-party cloud hosting services (such as Pixieset, Google Drive, or Dropbox) whose data servers may be located in jurisdictions outside of Jamaica.
Section 09
Promotional Use & Model Release
Unless explicitly revoked in a separate written addendum signed before the service is performed, the Client grants A.L.O.N.E. Studio an irrevocable, perpetual, worldwide right to use the media produced for:
- The Studio's portfolio and website
- Social media marketing and advertising campaigns
- General studio promotion and press features
Clients who wish to opt out of promotional use must submit a written revocation request before the service date. Requests made after the session will not be honoured.
Section 10
Client Responsibilities
Punctuality: Coverage begins at the confirmed start time. Client tardiness will result in a corresponding reduction of shoot time. The session end time will not be extended to compensate for delays without the application of overtime billing.
Location Permits: The Client is solely responsible for obtaining all necessary clearances, municipal permits (including those from the Portmore or St. Catherine Municipal Corporations), environmental permits (including NEPA or UDC approvals for beach access), and paying all associated location fees. The Studio bears no liability for shoots disrupted due to the Client's failure to secure proper authorisation.
Safe Working Environment: The Client guarantees a safe and non-hostile working environment. The Studio reserves the absolute right to immediately terminate coverage and depart if staff experience harassment, threats, or unsafe conditions. The full Total Fee remains payable.
Section 11
Cancellation & Rescheduling

Rescheduling requests must be submitted in writing at least 7 days before the scheduled service date. Only one reschedule is permitted per booking.
Section 12
Limitation of Liability
The Studio utilises professional-grade equipment with redundant memory systems and rigorous backup protocols. However, in the unlikely event of catastrophic hardware failure, media theft, or severe illness preventing the fulfillment of duties, the Studio's maximum aggregate liability is strictly limited to a full refund of all monies paid.
Under no circumstances shall the Studio be liable for consequential, indirect, emotional, or incidental damages arising from a breach of this agreement, including but not limited to the cost of restaging an event.
Section 13
Force Majeure
Neither party shall be held liable for failure or delay in performing obligations where such failure is directly caused by a Force Majeure Event that frustrates the core purpose of the agreement.
Force Majeure Events include: Acts of God (hurricanes, severe flooding, earthquakes), declared pandemics or epidemics, national states of emergency, government-mandated lockdowns, acts of terrorism, or severe regional transportation disruptions.
Remedy: Both parties shall act in good faith to reschedule. If rescheduling is fundamentally impossible, the Studio shall refund all payments made, less the non-refundable Retainer, which covers administrative, consultation, and preparatory costs already expended.
Section 14
General Provisions
- Governing Law: This agreement is governed by and construed in accordance with the laws of Jamaica. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Jamaica.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions continue in full force. The invalid provision will be modified to the minimum extent necessary to render it enforceable.
- Entire Agreement: This document constitutes the entire understanding between the parties and supersedes all prior oral or written agreements. No modification is valid unless executed in writing and signed by both parties.
- Amendments: The Studio reserves the right to update these Terms & Conditions. Clients will be notified of material changes prior to their service date.
