Service Booking Agreement
A.L.O.N.E. Studio (Creative Division) · Effective upon booking confirmation
I. Client Details & Service Information
Upon booking, the Client provides full name, physical address, phone number, and email address. The service type (Photography, Videography, or Hybrid), event/shoot category, date(s), scheduled times, total duration, and primary locations are confirmed in writing prior to service commencement. Coverage is continuous; transit between locations and required vendor meals are included within the agreed consecutive duration.
II. Compensation, Retainers & GCT
2.1 Total Service Fee
The total fee is agreed upon in writing during the consultation phase and confirmed before the retainer is collected.
2.2 Non-Refundable Retainer (Liquidated Damages)
To officially secure the date, time, and resources, the Client agrees to pay a non-refundable retainer of 50% of the Total Fee. This retainer constitutes liquidated damages — a genuine pre-estimate of loss in the event of cancellation — and is non-refundable under all circumstances barring a direct breach by the Company.
2.3 Balance Payment
The remaining 50% balance is due no later than 14 calendar days prior to the Scheduled Date. Failure to remit the balance by the due date results in immediate service suspension and forfeiture of the retainer.
2.4 General Consumption Tax (GCT)
In accordance with Jamaican tax law, GCT at the rate of 15% is applicable on all photography and cinematography professional services. GCT is calculated on the base service fee and added to the total invoice. The Client is responsible for the full amount including GCT. Basic food items and certain prescribed goods are exempt, but creative professional services are fully taxable.
2.5 Late Payment
Outstanding balances incur compound interest at 1.5% per month (18% per annum), or the maximum permitted under Jamaican law, whichever is lower. The Client is also responsible for all reasonable legal and collection fees.
III. Add-Ons & Additional Services
Additional hours are billed at the agreed hourly rate, strictly subject to the Company's schedule availability. Optional add-ons include: Second Shooter/Assistant, Behind The Scenes (BTS) Content, and Drone (UAS) Coverage.
Drone / UAS Compliance
All Unmanned Aircraft Systems operations within Jamaican airspace are governed by the Jamaica Civil Aviation Authority (JCAA). Drone coverage is contingent upon favourable weather, a valid Special Aerial Work Permit from the JCAA, and the pilot's real-time safety assessment. The Company is legally prohibited from flying over heavy crowds, above 400 feet, or beyond visual line of sight. If drone operations must be grounded, a pro-rated refund solely for the drone add-on will be issued.
IV. Delivery & Archival
Standard delivery of final digital content is provided within the agreed number of business days following the Date of Service. Rush delivery options (48–72 hours at +20%; 24–48 hours at +30%) are available subject to studio availability.
Final deliverables are issued via a secure digital download gallery link sent to the Client's registered email. The Company maintains the active gallery for 60 days following initial delivery. After this period, the Company holds no obligation to store or retrieve media. The Client assumes sole responsibility for downloading and backing up all files immediately upon receipt.
V. Creative Control & Artistic Rights
The Company retains absolute creative control over lighting, composition, stylistic execution, and post-production. The Client acknowledges they are hiring based on the Studio's established public portfolio and unique artistic vision. The Client may not reject deliverables or demand refunds on the basis of subjective aesthetic preference. RAW/unedited files are not provided unless explicitly agreed in writing prior to service.
VI. Intellectual Property & Licensing
In accordance with the Jamaica Copyright Act 1993 (and amendments), the Company is the exclusive first owner of copyright for all photographs and video footage created under this Agreement. Execution of this Agreement does not constitute a "work made for hire" and no transfer of underlying copyright is implied.
Upon full final payment, the Client receives a licence based on selection at time of booking: Personal Use Licence (non-exclusive, non-transferable, perpetual — for personal, non-commercial use only) or Commercial Use Licence (additional fee — subject to a separate Commercial Addendum).
For all public digital deployments — especially by content creators, influencers, or brands — clear and legible credit to "A.L.O.N.E. Studio" must be provided in all captions.
VII. Data Protection (JDPA Compliance)
The Client consents to the Company processing personal and biometric data in full compliance with the Jamaica Data Protection Act (2020) solely for the fulfilment of this Agreement. The Client also consents to the use of third-party cloud hosting services (e.g. Pixieset, Google Drive, Dropbox) whose servers may be located outside Jamaica.
VIII. Model Release & Promotional Use
Unless revoked in a separate written addendum signed prior to execution of this Agreement, the Client grants the Company an irrevocable, perpetual, worldwide right to use the produced media for the Company's portfolio, website, social media, advertising campaigns, and general studio promotion.
IX. Client Responsibilities & Venue Permits
Service coverage begins strictly at the Scheduled Start Time. Client tardiness results in a corresponding deduction of shoot time; end time will not be extended without overtime billing. The Client is exclusively responsible for obtaining all municipal permits (including those from the Portmore or St. Catherine Municipal Corporations), NEPA or UDC approvals for beach access, and any associated location fees. The Company bears no liability for shoots halted by authorities due to the Client's failure to secure authorisation.
The Client guarantees a safe, non-hostile working environment. The Company reserves the right to immediately terminate coverage if staff experience harassment, threats, or unsafe conditions, with the full Total Fee remaining payable.
X. Cancellation & Rescheduling
Cancellation: If the Client cancels, the Retainer is permanently forfeited. If cancellation occurs within 14 calendar days of the Scheduled Date, the Client remains liable for 100% of the Total Fee.
Rescheduling: One reschedule is permitted with at least 7 days' written notice, subject to availability, and incurs an administrative fee of 15% of the Total Fee. If the Company is unavailable on the new date, the request is treated as a cancellation.
XI. Limitation of Liability & Force Majeure
In the event of catastrophic equipment failure, theft of media, or severe illness, the Company's maximum aggregate liability is limited to a full refund of all monies paid. The Company is not liable for consequential, indirect, emotional, or incidental damages.
Force Majeure events (Acts of God, declared pandemics, national emergencies, acts of terrorism, severe transportation disruptions) excuse both parties from liability. The parties will act in good faith to reschedule. If rescheduling is impossible, all payments are refunded less the non-refundable Retainer.
XII. General Provisions
This Agreement is governed by the laws of Jamaica. Any disputes are subject to the exclusive jurisdiction of the Courts of Jamaica. If any provision is found unenforceable, remaining provisions remain in full force. This document constitutes the entire agreement between the parties and supersedes all prior oral or written agreements on the subject matter.
